Terms of Service

1. About the Services
Red River Dynamics provides software tools that process supported unmanned-aircraft flight logs and present health indicators, trends, findings, maintenance priorities, and performance reports. The Services are decision-support tools. They do not constitute an airworthiness determination, regulatory approval, engineering certification, maintenance release, or guarantee of safe operation.
2. Operator responsibility
You remain solely responsible for aircraft inspection, maintenance, configuration, mission planning, regulatory compliance, pilot qualification, operational decisions, and safe flight. You must evaluate all findings against the aircraft manufacturer's documentation, applicable maintenance procedures, operating limitations, and the judgment of qualified personnel. Do not delay a required inspection or continue an unsafe operation because the Services do not identify a problem.
3. Eligibility and accounts
You must be legally able to enter into a binding agreement and must provide accurate account and billing information. You are responsible for safeguarding credentials and for all activity conducted through your account. Notify us promptly through the contact form on the Red River Dynamics website if you suspect unauthorized access.
4. Customer data and flight logs
You retain ownership of flight logs, aircraft information, maintenance records, and other material you submit (“Customer Data”). You grant Red River Dynamics a limited, non-exclusive license to host, copy, process, transmit, and display Customer Data only as reasonably necessary to provide, secure, support, and improve the Services.
You represent that you have the rights and permissions required to upload and process Customer Data. Do not upload classified information, export-controlled technical data, personal information you are not authorized to provide, or material whose processing would violate law, contract, policy, or duty.
5. Acceptable use
You may not use the Services to:
- violate any law, regulation, court order, export restriction, or third-party right;
- interfere with, disrupt, probe, or bypass security or access controls;
- introduce malware or attempt unauthorized access to systems or data;
- reverse engineer or copy protected portions of the Services except where law expressly permits it;
- resell or provide the Services to third parties unless your plan or a written agreement allows it; or
- use reports as a substitute for required inspections, maintenance, certification, or qualified judgment.
6. Trials, subscriptions, and billing
Trial length, included usage, pricing, and plan limits are shown at checkout or on the pricing page. Unless canceled before the trial ends, a trial may automatically convert to the selected paid plan and the payment method on file may be charged. Paid subscriptions renew automatically for the stated billing period until canceled. Cancellation stops future renewal charges but does not ordinarily create a refund for an already-started billing period, except where required by law or expressly stated.
Taxes, overages, and usage-based charges may apply when disclosed at checkout or in your plan. We may change future pricing or plan features with reasonable notice. Changes do not retroactively alter charges already paid.
7. Service availability and changes
We work to keep the Services available, but uninterrupted or error-free operation is not guaranteed. Analysis may be delayed or limited by unsupported logs, incomplete telemetry, corrupt files, missing signals, third-party outages, maintenance, or technical constraints. We may modify, suspend, or discontinue features when reasonably necessary.
8. Intellectual property
Red River Dynamics and its licensors retain all rights in the Services, software, interfaces, documentation, models, report designs, trademarks, and other proprietary materials, excluding Customer Data. No rights are granted except the limited right to use the Services under these Terms.
9. Feedback and aggregated information
You may provide feedback voluntarily. We may use feedback without restriction or compensation. We may also create and use aggregated or de-identified information that does not reasonably identify you, your organization, or a specific aircraft, subject to applicable law.
10. Third-party services
The Services may depend on third-party hosting, authentication, payment, email, analytics, or infrastructure providers. Your use of a third-party service may also be governed by that provider's terms. Red River Dynamics is not responsible for independent third-party products or services.
11. Confidentiality
Each party will use reasonable care to protect non-public information received from the other party that is identified as confidential or should reasonably be understood to be confidential. This duty does not apply to information that is public through no breach, already lawfully known, independently developed, or lawfully received without a confidentiality duty. Required legal disclosures may be made after reasonable notice when permitted.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” RED RIVER DYNAMICS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RESULTS. WE DO NOT WARRANT THAT EVERY DEFECT, FAILURE, HAZARD, OR MAINTENANCE CONDITION WILL BE DETECTED OR CORRECTLY CLASSIFIED.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RED RIVER DYNAMICS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL; AIRCRAFT DAMAGE; MISSION LOSS; OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RED RIVER DYNAMICS' TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID RED RIVER DYNAMICS FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Red River Dynamics and its personnel from claims, damages, losses, and reasonable expenses arising from your Customer Data, unlawful or unsafe use of the Services, violation of these Terms, or infringement of another person's rights.
15. Suspension and termination
You may stop using the Services and cancel your subscription at any time. We may suspend or terminate access for nonpayment, security risk, unlawful activity, material breach, or conduct that threatens the Services or other users. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limitations, indemnification, and dispute provisions.
16. Governing law and disputes
These Terms are governed by the laws of the State of North Dakota, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes will be brought in the state or federal courts located in North Dakota, and each party consents to those courts' jurisdiction.
17. Changes to these Terms
We may update these Terms to reflect service, legal, security, or operational changes. We will post the revised version and update the effective date. When a change is material, we will provide additional notice when reasonably appropriate. Continued use after the effective date constitutes acceptance of the revised Terms.
